{"id":15080,"date":"2023-05-11T12:22:59","date_gmt":"2023-05-11T10:22:59","guid":{"rendered":"https:\/\/www.balak.sk\/general-terms-and-conditions\/"},"modified":"2025-10-08T09:17:46","modified_gmt":"2025-10-08T07:17:46","slug":"general-terms-and-conditions","status":"publish","type":"page","link":"https:\/\/www.balak.sk\/en\/general-terms-and-conditions\/","title":{"rendered":"General Terms and Conditions"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><p>[vc_row][vc_column][vc_column_text]<\/p>\n<ol>\n<li><strong>  Orders for companies<\/strong><\/li>\n<\/ol>\n<p>You can order goods via the online shop, by e-mail or by phone on +421 949 149 474, +421 948 693 691.<\/p>\n<ol start=\"2\">\n<li><strong>  Delivery date of ordered goods<\/strong><\/li>\n<\/ol>\n<p>All our parcels are delivered by courier or by personal collection at the <strong>Balak<\/strong> shop <strong>, Galvaniho 2\/A, 821 04 Bratislava.<\/strong> If the ordered goods are in stock, the delivery time usually varies from 24 &#8211; 72 hours depending on the availability of the courier company. If the goods need to be ordered from the manufacturer and the manufacturer has them in stock, the delivery time is usually 7 &#8211; 14 working days. If the goods are not even in stock with the manufacturer and therefore need to be manufactured, the delivery time will be communicated to the customer individually. Balak.sk reserves the right to change the delivery date due to the logistics load of the manufacturers. Delivery dates are for information purposes only, i.e. they are not binding and are subject to separate order confirmation.    <\/p>\n<ol start=\"4\">\n<li><strong>Orders of larger quantities and goods on order &#8211; Deposit<\/strong><\/li>\n<\/ol>\n<p>When ordering a larger quantity of goods (it is on order, we do not have it in stock) according to the customer&#8217;s requirements, the buyer can be issued an advance invoice for 50% (as a deposit) of the final price of the ordered goods. When the customer cancels the order, the deposit is non-refundable if these goods have already been delivered from the manufacturer. This also applies to goods on order.  <\/p>\n<ol start=\"5\">\n<li><strong>Transport of goods<\/strong><\/li>\n<\/ol>\n<p>The buyer pays for the delivery of the goods for orders up to 200\u20ac excluding VAT in the amount of 5\u20ac excluding VAT. For cash on delivery we charge the amount of +1,25\u20ac without VAT. Shipping costs over 200\u20ac excluding VAT by Parcel Parcel service are included in the price of the goods, so it is free, but only for orders over 200\u20ac by Parcel Parcel service. In case of ordering goods with a total value higher than 200\u20ac excluding VAT, which must be sent by Pallet Cargo, we charge the shipping fee according to the carrier&#8217;s table. The price is charged according to the weight or volume of the product, which we will calculate for you on the basis of the order. This means that the price of the order may not be final, as the online shop cannot calculate this accurately.     <\/p>\n<ol start=\"6\">\n<li><strong>Methods of payment for goods<\/strong><\/li>\n<\/ol>\n<p>The customer can opt for different methods of payment for the ordered goods:<\/p>\n<ol>\n<li>payment in cash on receipt of goods<\/li>\n<li>payment in advance &#8211; transfer to account<\/li>\n<li>payment on invoice according to the agreement and agreed terms and conditions<\/li>\n<\/ol>\n<ol start=\"7\">\n<li><strong>Technical parameters of delivered goods<\/strong><\/li>\n<\/ol>\n<p>The technical parameters of the goods listed in the information in the e-shop may in some cases differ slightly from the actual data, especially if they have been modified by the manufacturer &#8211; the introduction of a newer model &#8211; series, or if they have been incorrectly stated by the manufacturer of the goods itself.<\/p>\n<p><strong>  7a. Assembly of delivered goods <\/strong><\/p>\n<p>Installation of the goods must be carried out by a professional installer, service or a person who has sufficient experience in the installation of the goods. If the goods have been assembled in an unprofessional manner, the manufacturer of the product may reject any claim. <\/p>\n<ol start=\"8\">\n<li><strong>Receipt of goods<\/strong><\/li>\n<\/ol>\n<p>Ordered goods are delivered exclusively by courier service, our own transport or personal collection at the store in Bratislava. Please check the goods (quantity and quality of goods, technical parameters, accessories) upon receipt. The customer is obliged to immediately report any damage or missing parts to the courier\/seller who delivered the goods. Subsequent complaints about the quantity and specification of the delivered goods may not be accepted due to the absence of a damage report. Shipments dispatched by us are properly packed and inspected.    <\/p>\n<ol start=\"9\">\n<li><strong>24 months warranty<\/strong><\/li>\n<\/ol>\n<p>The manufacturer \/ seller is fully liable for manufacturing and material defects within the meaning of the provisions of the Civil or Commercial Code for a period of 24 months from the date of purchase of the product. The warranty does not cover defects caused by unauthorized intervention, as a result of using the goods for a purpose other than that for which the goods are intended, improper storage, mechanical damage not caused by wear and tear during normal use, exposure of the product to excessive loads, natural disasters. For the purposes of the warranty certificate, the document issued upon purchase of the product containing the name of the seller&#8217;s company, ID number, registered office and information about the goods sold shall be used.  <\/p>\n<ol start=\"10\">\n<li><strong>Complaints<\/strong><\/li>\n<\/ol>\n<p><strong>Complaint protocol &#8211; <\/strong><u><br \/>\n  <a href=\"https:\/\/www.balak.sk\/wp-content\/uploads\/2023\/10\/reklamacny-protokol-bmmedia.pdf\">Download here<\/a><br \/>\n<\/u><\/p>\n<p>Complaints are governed by the Civil Code, the Commercial Act for Consumer Protection. You can deliver the goods to be claimed in person, send them by Slovak Post or deliver them by courier service or transport company to our address Ing. Martin Bal\u00e1\u017e &#8211; BM MEDIA, Galvaniho 2\/A, 821 04 Bratislava. (We do not accept goods sent on delivery !!! ). The goods must be clean and must be accompanied by a proof of purchase or a copy thereof. If the nature of the goods requires it, we also require a copy of the proof of professional assembly . The claim period starts on the day the goods are delivered to our address. It is not possible to lend the customer replacement goods during the warranty period.       <\/p>\n<ol start=\"11\">\n<li><strong>Withdrawal from the contract of sale<\/strong><\/li>\n<\/ol>\n<p><strong>Withdrawal from the contract &#8211; protocol &#8211; <\/strong><u><br \/>\n  <a href=\"https:\/\/www.balak.sk\/wp-content\/uploads\/2023\/10\/odstupenie_od_zmluvy-balak.pdf\">Download here<\/a><br \/>\n<\/u><\/p>\n<p>The purchase of goods where the final recipient is a<strong> company \/ entrepreneur is not governed by the Civil Code and in this case it is not possible to unilaterally withdraw from the contract of sale.<\/strong><\/p>\n<p>If the online store makes a mistake by sending the wrong goods, the supplier will pay the shipping and the buyer will be refunded the total purchase price of the goods including shipping.
